Political Uncertainty and Budget Reality Put France in a Financial Vise

A rating agency’s warning about the country’s ballooning debt comes as the prime minister tries to push an austerity budget through a divided Parliament.

France has become one of the most financially troubled countries in Europe, with an outsize debt and deficit that are likely to keep ballooning despite efforts by a fragile new government to address the problem, the Fitch Ratings agency said on Friday.

A day after France’s new prime minister, Michel Barnier, introduced a tough austerity budget aimed at mending the nation’s rapidly deteriorating finances, Fitch issued a negative outlook for France’s sovereign credit rating. The rating was left unchanged at an AA– level for now, but Fitch warned that it could be revised lower if the government’s budget plans fall apart.

The outlook reflects greater financial risks that have swirled in France since President Emmanuel Macron dissolved the lower house of Parliament in June and took until last month to appoint a new government. The episode left Parliament deeply divided, split nearly evenly between warring political factions on the left, right and center, and leaving Mr. Barnier with no clear majority. That will make it harder to pass a belt-tightening budget and assuage nervous international investors at a time when France’s national debt has ballooned to more than 3 trillion euros ($3.28 trillion).

In a statement late Friday after Fitch’s announcement, France’s economy minister, Antoine Armand, said the government was determined “to turn around the trajectory of public finances and control debt.”

France is the second-largest economy among the 20 countries that use the euro currency, and as such, is considered too big to fail. European Union rules require members to have sound finances, including capping debt at 60 percent of economic output and not letting government spending exceed revenues by more than 3 percent.

But France is now well in excess of both of those limits, drawing a formal rebuke recently from the European Union. France’s debt has spiraled to more than 110 percent of economic output, the worst in the bloc after Greece and Italy. Fitch warned that the debt could surge to more than 118 percent of gross domestic product by 2028 if nothing is done. The annual budget deficit is set to widen to 6.1 percent of gross domestic product this year, much higher than expected, and an increase of more than 10 percent from last year.

French officials boast of crypto-ready laws that contrast with a stuttering enforcement campaign from the U.S. SEC – and are looking to the next generation of Web3 gaming rules.

PARIS, France – Officials in France are boasting of the regulatory certainty they can offer, as U.S. enforcers wage a fierce – if not entirely successful – war on crypto.

With a crypto registration regime in effect for years, new EU laws known as MiCA set to take effect in 2024, and lawmakers discussing a regime for gaming involving non-fungible tokens (NFTs), officials are bullish about the country’s preparedness for Web3, a conference organized by lobby group ADAN was told.

MiCA, which lets wallet providers and exchanges operate across the EU with a single license, “will allow this sector to go to the next gear in terms of regulatory requirements,” said Marie-Anne Barbat-Layani, adding that France’s Financial Markets Authority (AMF), the regulator which she chairs, is “resolutely open to innovation.”

Barbat-Layani contrasted France’s situation with that across the Atlantic.

“Some of our peers, notably the U.S. SEC [Securities and Exchange Commission], have launched litigation strategies – strategies of which the successes aren’t totally clear – but which seek to treat crypto as a traditional financial instrument,” she said. “It’s a different choice to that made in Europe.”

MiCA, which passed into law in June and takes full effect in December 2024, adapts existing rules for trading in financial instruments, while the SEC has taken action against a number of crypto companies including Binance and Coinbase, arguing that they should have registered as securities trading platforms under existing rules, and that certain tokens they’ve listed should have been registered as securities.

That U.S. approach may have met a setback last week with a ruling that found Ripple’s XRP token doesn’t necessarily fall under the current, century-old securities laws.

Undimmed

France has positioned itself as a crypto hub, and companies such as Binance have registered under its existing crypto law known as PACTE, which is administered by the AMF. On Tuesday, the AMF awarded its first ever crypto license to Forge, the financial-technology arm of the bank Societe Generale, a still more demanding process that already puts Forge largely in line with MiCA.

Being regulated comes with ups and downs – as Binance found recently, when it was raided by the Paris public prosecutor for “aggravated money laundering.” Binance has said it’s cooperating with investigators, and the incident doesn’t seem to have dimmed its enthusiasm for the country.

There’s “no reason” to leave France because of that probe, Binance France’s Executive Director for Legal Stéphanie Cabossioras told the conference, adding that recent events were just part of adapting to life as a traditional finance-style regulated entity. “There are little surprises … but it will become day-to-day life.”

While entrepreneurs in France may complain of high taxes, employment restrictions, and a paucity of investment available via venture capital, the country also offers bonuses beyond regulatory certainty, says the founder of one of the country’s crypto success stories, Ledger.

“Why is Ledger in France? Its foundational technology is the smart card,” asked Éric Larchevêque, Ledger’s former chief executive officer, of the chip-based hardware. “It’s a French innovation, a technology really mastered in France… but not at all in the U.S.”

Gambling

Now, France is hoping to build on its regulatory success by legislating for a new regime for Web3-style games involving monetizable digital objects – tradable merchandise that gives rights within the game and whose value can be increased by playing more – known by its French acronym of JONUM.

If lawmakers agree a framework in the fall, there could be a “text by the end of the year,”

Isabelle Falque Pierrotin, chair of France’s National Gambling Authority (ANJ) told the event – adding that her preference was for legislation to merely set high-level objectives, such as protecting children, allowing her to negotiate details with the sector.

In May, French Web3 company Sorare, under regulatory pressure, announced changes to its NFT soccer game for the domestic market – though the ANJ only intended these as a short-term fix pending legislative changes.

If enacted, some believe those new gaming laws could make a real difference.

“What is currently being foreseen, the last versions of the regime that were discussed in the Senate a few weeks ago, show a true will and a true possibility of positioning France as the real pioneer and leader on this topic,” said Matthieu Lucchesi, an innovation and fintech specialist at law firm Gide255, adding that the law needed to be “well-calibrated” in order to be appealing.

Fleeing U.S. Crypto Firms ‘Welcome,’ French Regulator Says #prizmabet

100-odd companies could be registered in France as the just-agreed MiCA EU crypto legislation beds in, Financial Markets Authority officials said

PARIS, France – Crypto companies fleeing U.S. regulatory uncertainty have been offered a welcome in France, by officials boasting a regulatory framework that offers relative predictability.

The European Union member already boasts around 74 registered crypto companies – a number that could surge to 100 as a last round of firms seek to anticipate the EU’s Markets in Crypto Assets rules that were formally signed off by ministers earlier Tuesday.

“In France, we are proud to be pioneers” with the crypto service asset provider regime, known as PSAN, that was legislated in 2019, Benoît de Juvigny, Secretary General of the Autorité des marchés financiers (AMF), told reporters Tuesday.

“If American players want to benefit, in the very short term, from the French regime, and from the start of 2025 from European arrangements, clearly they are welcome,” he added. “We have good relations and discussions with our U.S. counterparts.”

The legal certainty now apparently achieved in France is only recently gained. In January, lawyers were warning that legislative amendments proposed by the national Senate – eventually watered down – could kill innovation.

There are also still some gray areas: French lawmakers are still pondering what kinds of crypto social media influencers should be able to promote. The EU is still deliberating on how to regulate financial services that have no central entity, and Juvigny said the AMF will produce a paper with some ideas in the coming weeks.

But essentially the legal framework is all but nailed down, contrasting sharply with the situation across the Atlantic. In recent weeks, players including Bittrex and Coinbase have quit the U.S., or threatened to, citing the uncertain regulatory environment caused by active regulatory enforcement, combined with no obvious prospect of a crypto law from Washington.

Not easy

France may be predictable and stable, but that’s not the same as being easy or straightforward.

Seventy-four companies, including Binance and Bitstamp, have already been awarded a registration demonstrating basic governance and money-laundering compliance. Firms can also take the further step of seeking a license, if they have enough capital, though no company has yet acquired one.

Under new transitional measures agreed earlier this year as a bridge to MiCA, companies applying as of July will undergo a “reinforced” registration, in which they have to prove they have resilient IT systems and a conflict of interest policy. MiCA itself, set to take effect in 2025, grants the right to serve the pan-European market, and extends wider to include services such as crypto investment, advice and portfolio management.

That web of four different coexisting regimes is complex, as de Juvigny himself concedes – but officials are keen to bat off complaints from the industry that some requirements are impossible to meet in practice, and procedures unduly lengthy.

Complaints

Contrary to some industry concerns, officials say it’s indeed possible for crypto firms to get commercially insured to AMF standards. “I’ve seen the contracts with my own eyes,” Stéphane Pontoizeau, a director at the AMF responsible for supervising market infrastructure and intermediaries, told reporters.

Those who do their homework by studying the AMF’s guidelines will find they can acquire a new status in just a few months, Pontoizeau said – adding that those who find it takes longer often didn’t get their house in order.

With dozens likely waiting in the wings to get registered, there could be around a hundred companies on the “start line” in France before MiCA kicks in, Pontoizeau said – though some, headquartered in other EU member states or serving only the French market, may not seek a full AMF license under the EU law.

And for some, France’s rigor may be the point – such as Circle, the stablecoin issuer which has applied for registration from the AMF, and said it also wants to seek a license.

Together with the ACPR, the arm of the French central bank responsible for vetting crypto companies’ money laundering compliance, “the AMF … have a strong reputation for being a major market regulator that is forward thinking but manages risk well,” Circle’s Vice President for Policy and Regulatory Strategy Teana Baker-Taylor told CoinDesk. “It’s not a light touch jurisdiction.”
